MODEL RELEASE

This release is giving permission (or not) to use photos of you taken during the mentored hunt weekend. These photos could be used on the website, on our social media, and in other print/digital applications, by TLF directly, or by an affiliated organization.

You do NOT have to agree to this release to participate in the mentored hunt, however we would like to strongly encourage you to agree. Photographs from events and the people who partake are very important to TLF. They are an avenue for sharing what we do and the importance of this type of programming. Media is essential to meeting the demands of our funding streams that allow us to offer these mentored hunts and other events.

If you choose to opt out of this release, we will do our best to avoid capturing images of you. We ask that you aid this effort by taking it upon yourself to separate physically from group photo situations, and the gentle issuing of reminders if necessary. Please note that TLF cannot take responsibility for the actions of individuals participating in the mentored hunt.

I, herby grant Team Lady Fowlers and their assigns, licensees, successors in interest, legal representatives, and heirs the irrevocable right to use my name (or any fictional name), picture, portrait, or photograph in all forms and in all media and in all manners, without any restriction as to changes or alterations (including but not limited to composite or distorted representations or derivative works made in any medium) for advertising, trade, promotion, exhibition, or any other lawful purposes, and I waive any right to inspect or approve the photograph(s) or finished version(s) incorporating the photograph(s), including written copy that may be created and appear in connection therewith.

I hereby release and agree to hold harmless members of Team Lady Fowlers, and their assigns, licensees, successors in interest, legal representatives and heirs from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of the photographs, or in any processing tending toward the completion of the finished product, unless it can be shown that they and the publication thereof were maliciously caused, produced, and published solely for the purpose of subjecting me to conspicuous ridicule, scandal, reproach, scorn, and indignity.

I agree that the Photographer owns the copyright in these photographs and I hereby waive any claims I may have based on any usage of the photographs or works derived therefrom, including but not limited to claims for either invasion of privacy or libel.

Please read the following release, and show that you accept or decline below. Note that refusing to accept the release of liability may prevent you from being able to participate in a mentored hunt with Team Lady Fowlers.

RELEASE OF LIABILITY

Manitoba Mentored Hunt Program Partners (Manitoba Wildlife Federation Inc., Ducks Unlimited Canada, Delta Waterfowl, Wild Gobblers Unlimited; and Conservation and Water Stewardship) and its directors, officers, employees, instructors, assistant instructors, members, guests, volunteers, agents, representatives, successors and assigns and any other person or organization participating in or connected with the activities (hereinafter collectively referred to as the “RELEASEES”).

In consideration of THE RELEASEES allowing me to participate in Mentored Hunt Program activities, I hereby agree as follows:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer or that my next of kin may suffer as a result of my participation in Mentored Hunt Program activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER ANY APPLICABLE OCCUPIERS LIABILITY LEGISLATION OR LAW ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF MENTORED HUNT PROGRAM ACTIVITIES;

2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any property damage or personal injury to any third party resulting from my participation in Mentored Hunt Program activities;

3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;

4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province or Territory in which the Mentored Hunt Program activities take place and no other jurisdiction; and

5. Any litigation involving the parties to this Release Agreement shall be brought solely within the Province or Territory in which the Mentored Hunt Program activities take place and shall be within the exclusive jurisdiction of the Courts of that Province or Territory.

6. All contact and emergency contact information provided in accompanying Manitoba Mentored Hunt documents are accurate, and herein authorize the Mentored Hunt Program organizers to administer and/or obtain routine or emergency diagnostic procedures and/or routine emergency medical treatment and willingly accepts responsibility for any fees incurred in the medical treatment for participants in the Mentored Hunt Program activities, as deemed necessary in medical judgment.

In entering into this Release Agreement, I am not relying on any oral or written representations or statements made by the Releases with respect to the safety of Mentored Hunt Program activities, other by signing below, I the Participant or Parent/than what is set forth in this Release Agreement.
